Standard Operating Procedure

for Input Service Distributor (ISD) – (Post Registration)

(PAF Wing)

1. Brief Introduction:

In accordance with Section 20 of the Central Goods and Services Tax (CGST) Act, 2017, read in conjunction with Rule 39 of the CGST Rules, 2017, the concept of Input Service Distributor (“ISD”) is applicable when input services are centrally received and intended for distribution to multiple distinct persons as defined under Section 25 of the CGST Act, 2017.

An ISD refers to a centralized office that receives tax invoices for input services utilized by two or more units or branches registered under the same Permanent Account Number (“PAN”) but located in different States or Union Territories. The ISD mechanism facilitates the centralized receipt and proportionate distribution of Input Tax Credit (“ITC”) to the respective GST registrations of the distinct entities involved.

Where the Department of Posts (“DoP”) receives input services that benefit multiple distinct persons, it is legally mandated to obtain a separate ISD registration. This registration enables the DoP to distribute ITC proportionately to the respective units based on their turnover, as prescribed under Rule 39. The ISD is also required to furnish details of such distribution through Form GSTR-6 on a monthly basis.

Understanding and implementing the ISD framework is critical for ensuring compliance with GST regulations, particularly following the adoption of the One State One GSTIN model. Under this framework, each State or Union Territory is assigned a unique GSTIN, necessitating the use of the ISD mechanism for proper allocation of ITC on centrally procured input services. This initiative establishes a strategic compliance framework for executing ISD transactions within the Department of Posts, ensuring adherence to all applicable provisions of the Goods and Services Tax (“GST”) law.

2. Detailed Summary of Process for Compliance with the ISD Mechanism:

To ensure accurate and lawful distribution of ITC related to input services across various States and Union Territories, the DoP must adhere to the following structured steps under the ISD framework:

I. Identify the Supply:

The Drawing and Disbursing Officer (“DDO”) responsible for procuring input services from external vendors must first identify the nature of the inward supply.

The DDO must determine whether the input services:

 Are utilized by only one State/Union Territory, in which case the ISD mechanism is not applicable, or

 Are utilized by multiple States/Union Territories, thereby necessitating compliance with the ISD mechanism under Section 20 of the CGST Act.

This step is critical for establishing whether the ITC must be distributed across multiple GSTINs.

II. Communication of correct GSTIN to the Vendors:

Following the identification of input services that qualify for distribution under the ISD mechanism, the DDO must ensure that the correct ISD registration number is communicated to all relevant vendors.

In cases where input services are intended for use by multiple States or Union Territories, the DDO must instruct vendors to issue tax invoices in the name of the ISD registration number, rather than any individual State level GSTIN.

III. Invoicing and Distribution of ITC:

Upon receipt and verification of all relevant data, the Accounts Wing of the PAO shall initiate the distribution of ITC to the respective recipient units in accordance with the methodology prescribed under Rule 39 of the CGST Rules, 2017. The distribution process shall adhere to the following principles:

a) ITC available for distribution in a given month shall be distributed within the same month, and the details must be furnished in Form GSTR-6, as per the provisions of Chapter VIII of the CGST Rules.

b) The amount of ITC distributed shall not exceed the total credit available for distribution.

c) ITC attributable to a specific recipient shall be distributed exclusively to that recipient.

d) ITC attributable to multiple recipients shall be distributed pro rata, based on the turnover in a State or Union Territory of each recipient during the relevant period, relative to the aggregate turnover of all such recipients who are operational during the same period.

e) ITC attributable to all recipients shall be distributed pro rata using the same turnover-based methodology as outlined in clause (d).

f) The ITC to be distributed to a recipient “R1” shall be calculated using the following formula:

C1 = (t1 / T) x C

Where:

 C1 = ITC to be distributed to Recipient “R1”

 C = Total ITC available for distribution

 t1 = Turnover of recipient “R1” during the relevant period  T = Aggregate turnover of all recipients to whom the input service is attributable

g) The ISD shall separately distribute:

 Eligible ITC, and

 Ineligible ITC (as defined under Section 17(5) or other applicable provisions).

h) The ITC on account of Central Tax, State Tax, Union Territory Tax, and Integrated Tax shall be distributed separately, in accordance with clauses (d) and (e).

i) ITC on Integrated Tax shall be distributed as Integrated Tax to all recipients.

j) ITC on Central Tax and State/UT Tax shall be distributed as follows:

 If the recipient is located in the same State/UT as the ISD, the credit shall be distributed as Central Tax and State/UT Tax.

 If the recipient is located in a different State/UT, the credit shall be distributed as Integrated Tax, equal to the aggregate of Central and State/UT Tax eligible for distribution.

k) The ISD shall issue an ISD Invoice, as per Rule 54(1), clearly indicating that it is issued solely for the purpose of ITC distribution.

l) In case of reduction in ITC already distributed, the ISD shall issue an ISD Credit Note, as per Rule 54(1).

m) Any additional ITC arising from a Debit Note issued by the supplier shall be distributed in accordance with clauses (a) to (j) and calculated using the formula in clause (f). Such credit shall be distributed in the month in which the debit note is reported in Form GSTR-6.

n) Any ITC reduction due to a Credit Note issued by the supplier shall be apportioned to each recipient in the same ratio as the original distribution (clause f), and:

 Reduced from the ITC to be distributed in the month the credit note is reported in Form GSTR-6, or

 Added to the output tax liability of the recipient if the apportioned amount is negative due to excess adjustment.

IV. Auto-drafted details in Form GSTR-6A and filing of Form GSTR-6:

 Following the filing of Form GSTR-1 by the relevant GST-registered units, the ITC details are auto-populated in Form GSTR-6A.

 The Accounts Wing of the PAO shall review the auto-drafted entries and make necessary additions, corrections, or deletions before final submission of Form GSTR-6.

 Form GSTR-6 must be filed electronically via the GST portal, either directly or through a Facilitation Centre notified by the Commissioner.  The due date for filing Form GSTR-6 is the 13th of the succeeding month.  Once filed, the distributed ITC details are reflected in Part B of Form GSTR 2A of the respective recipient GSTINs, enabling them to claim the credit.  In months where no transactions occur, the PAO must file a Nil Form GSTR 6 return to maintain compliance.
