Summary

This Office Memorandum clarifies the revised limits for restricting officiating pay under Fundamental Rule 35 following the pay scale revisions recommended by the Fourth Central Pay Commission. The President has approved new percentage and minimum monetary limits on officiating pay across specified basic pay slabs.

  • The order applies to Central Government employees drawing pay in the revised pay scales under the Central Civil Services (Revised Pay) Rules, 1986, including staff of the Indian Audit and Accounts Department.
  • For employees in receipt of basic pay above Rs. 2200/-, the restriction under FR 35 is 12 1/2% of basic pay or Rs. 330/-, whichever is more.
  • For employees in receipt of basic pay above Rs. 1000/- up to Rs. 2200/-, the restriction is 15% of basic pay or Rs. 200/-, whichever is more.
  • For employees in receipt of basic pay of and below Rs. 1000/-, the restriction is 20% of basic pay.
  • The new rates are applicable with effect from the date an employee draws pay in the revised scale of pay under the Central Civil Services (Revised Pay) Rules, 1986.
  • This order modifies the limits contained in paragraph 2 of Department of Personnel and Training Office Memorandum No. 18/12/85-Estt.(Pay-I) dated 18th July, 1986, while all other conditions stipulated in that memorandum continue to apply.
  • For employees serving in the Indian Audit and Accounts Department, these orders are issued after consultation with the Comptroller and Auditor General of India.

OFFICE MEMORANDUM

Subject:— Restriction of ' officiating' pay under FR 35 — Clarification — regarding

​The undersigned is directed to say that consequent upon the revision of pay scales of the Central Government employees on the recommendation of 4th Pay Commission, the president is pleased to decide that the restrictions under FR 35 contained in para 2 of this Department's OM No. 18/12/85-Estt.(Pay-I), dated 18th July, 1986, will now be as under:— 

(a)For employees in receipt of basic pay above Rs.2200/-12-1/2% of basic pay or Rs.330/- whichever is more.
(b)For employees in receipt of basic pay above Rs.1000/- upto Rs.2200/-15% of basic pay or Rs.200/- whichever is more
(c)For employees in receipt of basic pay Of and below Rs.1000/-20% of basic pay.

2.​The new rates will be applicable with effect from he date an employee draws pay in the revised scale of pay applicable in accordance with the Central Civil Services (Revised ay) Rules, 1986.

3.​Other conditions as laid down in this Department's OM No. 18/12/85-Estt(Pay-I) dated 18th July, 1966 would however continue to apply.

4. ​In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders have been issued after consultation with the Comptroller and Auditor General of ndia.
